Agreement To Rules

By submitting an order form for any web site, e-mail account, domain hosting, database hosting, Website Design or complete hosting services with Future Web, the client agrees to all rules, regulations, and statements made in this Usage Agreement along with their consequences.

Client Responsibility

The client alone is responsible for the content of their web site and e-mail messages.

No unsolicited e-mailing practices shall be tolerated. This is to include any practices ascribed to the client, which may or may not involve a Future Web's web site hosting, e-mail account, domain hosting account, complete hosting services. This is to include any mass unsolicited e-mailing through the e-mail server of Future Web or any customer's any other services or e-mail account.

Upon reviewing any reports received by Future Web regarding the client's unsolicited e-mailing practices, Future Web reserves the right to terminate the client's web site hosting, e-mail account, domain hosting account, database hosting account and/or other services within 24 hours of notification of the client without refund of web site hosting, e-mail account or service fees which the client may have paid in advance.

No use of a client's Future Web's web site hosting, e-mail account, domain hosting account, database hosting account or any other services to promote, sell, trade, or give away the use of the following materials or information shall be tolerated: illegal material or information, stolen material or information, violation of trademarks, pirated material or information.

Upon reviewing any reports received by Future Web regarding the client's use of their Future Web's web site hosting, e-mail account, domain hosting account, database hosting account or any other services accounts in any of the above practices regarding the addressed (above) material or information, Future Web reserves the right to terminate the client's web site hosting, e-mail account, domain hosting account, database hosting account or any other services account within 24 hours of notification of the client without refund of web site hosting, e-mail account, domain hosting account, database hosting account or any other services account fees which the client may have paid in advance.

No use of a client's Future Web web site hosting, e-mail account, domain hosting account, database hosting account or any other services account to promote material of a sexually explicit or illegal nature shall be tolerated. Let it be known that offensive material falling under the category of "sexually explicit or illegal nature" shall include, but not be limited to the following: any nude pictures of a human being used to exploit, advertise, or sell any product or service; any sort of child pornography, or attempt to display a child in a sexually suggestive manner; any written material describing and/or promoting any sexually explicit, harsh, or abusive acts; any written material which is excessively profane and sexually explicit. Let it be known that at any time Future Web reserves the right to judge any material that it deems of an inappropriate adult or sexual nature intolerable for a Future Web's web site hosting, e-mail account, domain hosting account, database hosting account or any other services account, thus causing said material to be included under this category of "sexually explicit or illegal nature". Upon reviewing any reports received by Future Web regarding the client's use of their Future Web web site hosting, e-mail account, domain hosting account, database hosting account or any other services accounts in any of the above practices regarding the addressed material of a "sexually explicit or illegal nature", Future Web reserves the right to terminate the client's web site hosting, e-mail account, domain hosting account, database hosting account or any other services account within 24 hours of notification of the client without refund of web site hosting, e-mail account, domain hosting account, database hosting account or any other services account fees which the client may have paid in advance.

No use of a client's Future Web's web site hosting, e-mail account, domain hosting account, database hosting account or any other services account to promote unlawful discrimination against or hatred of any particular race, any particular nationality, or any particular religion shall not be tolerated. Let it be known that at any time Future Web reserves the right to judge any material to fall into the above categories, making it unacceptable for a client's Future Web web site hosting, e-mail account, domain hosting account, database hosting account or any other services account. Upon reviewing any reports received by Future Web regarding the client's use of their Future Web web site hosting, e-mail account, domain hosting account, database hosting account or any other services accounts in any of the above practices of promoting unlawful discrimination or hatred of any particular race - any particular nationality - or any particular religion, Future Web reserves the right to terminate the client's web site hosting, e-mail account, domain hosting account, database hosting account or any other services account within 24 hours of notification of the client without refund of web site hosting, e-mail account, domain hosting account, database hosting account or any other services account fees which the client may have paid in advance.

Future Web does not permit sites where 20% or more of the monthly traffic is from file downloads, or sites that use more than 10% of system resources, or sites which in Future Web’s view are detrimental to the enjoyment of Future Web services by Future Web’s other clients, or are in the sole and final judgment of the Host, detrimental to network or business operations, or exceed the account's designated monthly allowed bandwidth usage. File download and system resource restrictions do not apply to any other servicess; however, those servers that exceed their specified monthly traffic and bandwidth limits are subject to an extra monthly fee of $4 per each gigabyte of traffic exceeding their monthly limits and/or restrictions placed on their account by Future Web, at the sole discretion of Future Web.

No use of a client's Future Web's web site hosting, e-mail account, domain hosting account, database hosting account or any other services account shall be used for illegal activities, such as, but not limited to: denial of service attacks, port scanning, flooding of services on other servers, and flooding of services on Future Web servers. Other attacks not mentioned are also not tolerated, to be decided at the discretion of Future Web personnel. Future Web reserves the right to immediately deactivate the client's web site hosting, e-mail account, domain hosting account, database hosting account or any other services account without refund of web site hosting, e-mail account, domain hosting account, database hosting account or any other services account fees which the client may have paid in advance.

Future Web will be the sole and final arbiter as to website accounts, e-mail accounts, domain hosting accounts, database hosting accounts, any other services accounts or usages of resources that constitute violation or intent to violate our policies. Those users found in violation of these policies are subject to removal for any instance of violation. Accounts which Future Web must suspend or cancel due to violation of these rules are not eligible to receive a refund under our 30 money back guarantee. Acceptance of these Policies constitutes an acceptance of any fines or penalties which might arise out of violation of these policies.

Users with website accounts, e-mail accounts, domain hosting accounts, database hosting accounts, any other services accounts that do not comply with these simple rules, or who seek to take advantage of our unlimited traffic plan in any other way, will, at the discretion of Future Web, have their sites canceled and/or removed from the servers and penalty fees assessed at the discretion of Future Web.

Future Web reserves the right to make the judgment call on behalf our other Future Web clients who expect us to maintain our servers at maximum efficiency. We believe this is common sense. If you have any questions about it, please contact us.

All accounts are set up on a prepay basis. Although Future Web reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will be notified by an e-mail to renew their services. If they failed to do so then their account will be terminated immediately.

Customers will not be entitled to this benefit if they have previously had an account with Future Web unless the period of absence has been greater than one year. New customers will not be entitled to a trial period if any account has previously been created at the same postal address within the same 12 month time span.Transaction Charges will be deducted from the refund money.

Project Termination & Expiration Period (Web Design)

Project will be terminated (PT) in the event of non-correspondence from the client for 30 (Thirty) days from the last correspondence date while the project is still in progress. In this case Future Web is not liable to provide refund to the client. All charges and dues must be paid within 45 (Forty-Five) days from the last correspondence date.

In the event client still want to continue after the PEP (Project Expiration Period) Client is liable to pay $250.00 USD (Two Hundred Fifty United States Dollars) towards (RE) recontinuation of work + all pervious dues.

Refund: Web Design

Web Design projects are non-refundable. We do not provide refund on web design projects in any case. Please make sure you understand this point and by placing your order with Future Web you have agreed to this point.

Refund: Hosting

Please reffer to Point 13.

Future Web's Portfolio:

Future Web is entitled to feature/add your project in to their portfolio. By placing order with with Future Web, you agree to this point.

If you do not agree to this point then please discuss this point with your project leader before placing your order and request a PDF deceleration document signed by the Center Manager to confirm that Future Web will not feature your project in to their portfolio.

E-Commerce/Static Website Design.

Future Web's job is limited to design a working e-commerce/static website for you or your business. You will be requested to provide all the project related material in advance. Your website will be based on the information you provide to us. Future Web shall not be responsible for any wrong information provided by you related to your project.

Minor changes on request can be done to the clients website. Any major changes or additional changes can be done by paying extra charges.

FUTURE WEB WILL NOT AND SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES OR INJURY, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:

A: Merchant Account B: Shopping Cart C: Hosting D: Web Design and other related services provided by us or other services providers reffered by us.

Support

Future Web is liable to provide support for Hosting, Domain Name or Web Design services you purchased from us.

Future Web is not liable to privide customer support for your e-commerce merchant account or shoping cart. You will be advised to seek support directly from these services providers.

Account suspension

Future Web reserves all rights to suspend your account without perior intimation
